Implementation Measures for the Recording of Radio Transmission Equipment Sales (Interim)
Article 1 In order to strengthen the management of Radio transmission equipment, regulate the implementation and the supervision management of Radio transmission equipment sales record, and effectively maintain the order of airwaves, these Measures are formulated in accordance with the Radio Regulations of the People's Republic of China and relevant laws and regulations.
Article 2 These Measures apply to the filing and sale of Radio transmission equipment within the territory of the People's Republic of China and the supervision and management of the sale and registration of radio transmission equipment.
The Measures "radio transmitting equipment" as used in these Measures refers to the radio transmitting equipment approved by the model in accordance with the provisions of Article 44 of the Radio Regulations of the People's Republic of China.
Article 3 The national radio regulatory agency shall supervise and guide the sales recording of radio transmission equipment in the country, establish a national unified radio transmission equipment sales recording information platform (hereinafter referred to as the information platform), and promote the management, publicity, and inquiries of online processing and recording information for sales recording.
The radio regulatory agencies of the provinces, autonomous regions, and municipalities directly under the Central Government (hereinafter collectively referred to as provincial radio regulatory agencies) shall be responsible for the implementation, supervision and management of the sales recording of radio transmission equipment within their respective administrative areas, and investigate and deal with illegal acts in accordance with the law.
Article 4 Provincial Radio regulatory agencies shall follow the principles of openness, efficiency and convenience in the implementation of the management of the registration of radio transmission equipment.
Article 5 Where a radio transmission equipment is sold, it shall, within 10 working days from the date of commencement of sale, go through the information platform to the provincial radio management agency of the place where it is registered, and shall be responsible for the authenticity of the record information and accept the relevant Supervision and management implemented by the department according to law.
Article 6 The filing information shall include the business entity information and sales equipment information.
The business entity information shall include the name of the business entity, the unified social credit code, the contact person and contact information, the address of the physical business premises or the name and website of the online sales platform, and related documents, etc.
Sales equipment information should include equipment type, manufacturer name, equipment model, type approval code, etc.
Where local laws and regulations have clear provisions on other filing information, they shall be implemented in accordance with local laws and regulations.
Article 7 For the first time, the business entity applies for recording. After receiving the recording materials, the provincial radio administrative agency shall issue the recording subject number and the corresponding two-dimensional codes to it through the information platform within five working days if the materials are complete and conform to the statutory form.
Article 8 The sales of Radio transmitting equipment shall be marked with the recording subject number or the corresponding two-dimensional code at the physical business premises or network sales platform.
Article 9 If the contact person and the contact information of the business entity, the address of the entity's business premises or the name and website of the online sales platform are changed, the change procedure shall be handled through the information platform within 10 working days from the date of the change.
If the number of models of the radio transmission equipment sold is increased, the change procedure shall be completed within 10 working days from the date when the new equipment is started to be sold. If the sale of some types of radio transmission equipment is terminated, the formalities for change shall be handled in a timely manner.
Article 10 In any of the following circumstances, the business entity shall promptly record for cancellation through the information platform.
(1) Termination of the sale of radio transmitting equipment;
(2) The expiration of the business term;
(3) The business license has been revoked according to law or the enterprise legal person has gone through the cancellation of registration;
(4) Other circumstances as stipulated by laws, regulations and rules.
Article 11 The relevant circumstances of the business entity name of the radio transmission equipment sales recording, the unified social credit code, equipment information, etc. shall be disclosed to the public through the information platform.
Article 12 Where the radio transmission equipment that has been approved for SRRC has not been recorded for sale, the provincial radio management agency shall, in accordance with Article 77 of the Radio Regulations of the People's Republic of China, order it to make corrections, and those who refuse to make corrections shall be fined between 10,000 yuan and 30,000 yuan.
Article 13 Provincial radio regulatory agencies shall strengthen the supervision and inspection of the sales recording of radio transmission equipment, establish and improve the daily supervision and inspection system focusing on random sampling, randomly select the inspected objects, randomly select inspectors, and promptly release to the publish the spot check and inspection results.
In the case of supervision and inspection, if there is any act of providing false record materials, the provincial radio management agency shall order it to make corrections within a time limit; if it refuses to make corrections or fails to make corrections within the time limit, the provincial radio management agency shall announce the relevant situation to the public through the information platform.
Article 14 The Radio regulatory agency and its staff shall be obliged to keep confidential the information concerning trade secrets and the privacy of citizens.
