Implementation Rules for Self-Declaration of Compulsory Products Certification
Introduction
In order to deepen the reform and innovation of Quality certification system, optimize the certification procedure, through benchmarking the international advanced conformity assessment system, encourage enterprises to strengthen their main responsibility and reduce institutional transaction costs. While ensuring that the compulsory certification system continues to operate effectively and healthfully, allowing the products in part of CCC catalogue under the premise that the compliance risk is basically controllable, the producer (manufacturer) uses a self-declaration method to prove that the products it provides can consistently meet the applicable standards for Compulsory product certification and the relevant requirements of the implementation rules.
In order to regulate the related activities involved in the Compulsory certification self-declaration, this implementation rule is formulated.
The relevant parties involved in product production and supply chain shall carry out activities such as product design, production, import, sales, commercial use and conformity assessment in accordance with the requirements of laws and regulations and administrative normative documents, so as to ensure that the products provided can continue to meet the applicable standards for Compulsory product certification and the relevant requirements of the implementation rules.
The "self-declaration" referred to in this Implementing Rules means: The conformity evaluation method of “conformity assessment + conformity information submission + self-declaration” implemented by the producer according to “self-declaration procedure A” or “self-declaration procedure B” in the Annex 1 of this implementation rule.
Self-declaration and conformity information submission may involve the following parties: producers (manufacturers), authorized representatives, manufacturer, importers, vendors, business users, etc.
The products that are listed in the compulsory certification catalog and are allowed to use self-declaration to prove that the product continuously meets the applicable standards of compulsory certification and the relevant requirements of the implementation rules, must be manufactured, sold, imported, or used in other business activities after the completion of the evaluation of product applicable standards and related requirements (hereinafter referred to as product conformity), product conformity information submission, and marked CCC mark.
1 Scope
This rule stipulates the requirements of the definitions involved in conformity assessment activities that prove product conformity by self-declaration in compulsory certification, self-declaration procedures, conformity information submission and self-declaration requirements, CCC mark, self-selected laboratory requirements, and post-market supervision, responsibility and obligations of related parties.
The rule applies to products in the compulsory certification catalog that are allowed to use self-declaration to prove product compliance and are marked with the CCC mark.
2 Definition
2.1 Producer (manufacturer)
Produce or entrust others to design, produce products and sell under their name/trademark, enterprises with corporate status registered in China who are responsible for the quality of the product.
2.2 Authorized representative
Enterprise with a legal person status registered in China that Representing an overseas producer (manufacturer) with the written authorization of an overseas producer (manufacturer) to submit a self-declaration to the CNCA's conformity information submission system and submit the product's compliance information.
Note: Overseas producers can choose their subsidiaries, importers or sellers as authorized representatives.
2.3 Manufacturer
Enterprise who have been commissioned to actually complete the production and assembly of products.
2.4 Importer
Chinese enterprises with legal status from overseas imports to the Chinese market.
2.5 Seller
Chinese companies with legal status that sell products.
2.6 Business users
A company or individual that uses products for commercial operations in China.
2.7 Self-declaration procedure
The evaluation procedure that is used to determine whether the product meets the rules and the applicable standards of Compulsory certification and the relevant requirements of the implementation rules.
2.8 Self-declaration
The producer/authorized representative makes a commitment to confirm that the product meets the applicable standards of Compulsory certification and the relevant requirements of the implementation rules.
2.9 Self-selected laboratory
The producer /authorized representative autonomously selects the laboratories for non- Compulsory product certifications for type testing.
Note: The self-selected laboratory may be a laboratory owned by a producer or a manufacturing company, or it may be a third-party laboratory designated by other qualified non-compulsory product certifications.
2.10 Compulsory certification requirements
Compulsory certification related laws and regulations as well as the product range, certification basis, etc. specified in the corresponding implementation rules, involve the requirements of product compliance evaluation.
3 Self-declaration procedure
3.1 Producers combine the relevant requirements for Compulsory certification of products and use appropriate self-declaration procedures to evaluate the conformity of products.
The self-declaration method involves the self-declaration procedure refers to the self-declaration procedure A or the self-declaration procedure B provided in this implementation rule. See Annex 1 for details.
Note 1: All products that allow the use of self-declaration to prove product conformity, the producer/authorized representative can voluntarily choose to be certified by the designated certification body according to the existing methods.
Note 2: All products that allow the use of self-declaration procedure A to prove product conformity, the producer/authorized representative may voluntarily choose to have the designated certification body perform the certification in the existing methods or adopt the self-declaration procedure B.
3.2 The product adopting the self-declaration procedure A is arranged by the producer/authorized representative to perform the product type test in the self-selected laboratory and issue the type test report; the product adopting the self-declaration procedure B must be subjected to the compulsory certification designated laboratory to carry out the product type test and issue the type test report.
Type tests and reports shall be conducted in accordance with the relevant requirements of the product's compulsory certification implementation rules.
3.3 Producers should establish technical documents that should contain at least all the contents required by Annex 2.
3.4 The producer/authorized representative shall sign a self-declaration that shall contain at least all the content required by Annex 3 of this rule.
3.5 Producers/authorized representatives should keep self-declaration related information on file; when necessary, sellers and business users should also be able to provide or query the self-declaration information of the products they sell/use.
3.6 When product design, technical characteristics, relevant compulsory certification requirements, or self-declaration related information changes, the producer/authorized representative shall supplement to evaluate product conformity and update the self-declaration and compliance information based on the changes.
4 conformity information submission and self-declaration requirements
4.1 conformity information submission
Before the product is shipped out or imported, the producer/authorized representative shall register in the information submission system and submit a self-declaration and submit the following conformity information:
- Domestic producer Business registration certificate;
- Authorized to represent the business registration certificate (for overseas producers only);
c)Product description;
d)Type test based on standard information;
e) Type test report;
f) Self-selected /designated laboratory information and relevant qualification certificate (if applicable);
g) Factory Quality Assurance Ability Self-inspection Report;
h) Self-declaration signed by the producer/authorized representative。
The self-declaration and the submitted product names, model specifications, producers, manufacturers, trademarks and other information should be consistent with the actual product, and be covered by the contents of the type test report.
Laboratories who undertake self-declaration product type testing and issue reports (Self-selected CCC-designated laboratories) shall be in line with the actual situation of the producer / authorized representative, register in the conformity submission system and submit the type test report and related information.
4.2 Self-declaration result
The conformity information submission system generates a corresponding two-dimensional code based on the result of submission and publishes the results.
The producer/authorized representative signs the self-declaration with the two-dimensional code and marks the CCC mark on the product.
4.3 Change of submitted information
When product design, technical characteristics, relevant compulsory certification requirements, or self-declaration related information changes, the producer/authorized representative shall supplement to evaluate product conformity(if necessary) according to the changes, and update the technical documentation and the self-declaration information in the conformity information submission system. If the type test report content is changed, the laboratories (self-selected laboratories /CCC-designated laboratories) who undertake self-declaration product type test and issue report should be in line with the actual situation of the producer / authorized representative, register in the conformity information submission system and submit the change report of the producer/authorized representative self-declaration product.
In the event that the original submitted information was not cancelled, the change report can only be used for changes in the original conformity information.
4.4 Cancellation of submission information
The producer / authorized representative may cancel the information submitted by himself or herself as required. After cancellation, the system keeps the original information as required for reference.
The validity of the information retention is 10 years, and the system is automatically cancelled after expiration. Producers / authorized representatives may re-submit relevant information if necessary.
5 CCC Mark
The producer/authorized representative shall ensure that the management and use of the CCC mark complies with the "Compulsory Product Certification management regulations" and the "Announcement for the CNCA on the reform of compulsory product certification marks" (No. 10 Announcement of CNCA 2018) regulations, etc.
For the following products, the CCC mark shall not be marked:
- Products that are within the scope of this rule but do not conform to the requirements of this rule for conformity assessment, sign self-declaration, and submit compliance information;
b) Changed product after submitting compliance information but did not update compliance information;
c) Products that do not meet the Compulsory certification requirements。
Using Self-declaration method means that the product can continue to meet the Compulsory product certification requirements, and complete the product conformity information submitted by the product, the CCC mark should be marked:
When the size or characteristics of the product do not allow the marking of the CCC mark, the CCC mark shall be marked on the smallest package of the product or on the documentation accompanying the product.。
6 self-selected laboratory requirements
6.1 Qualification requirements for self-selected laboratories
The operation of a self-selected laboratory shall comply with the laws and regulations of the country (region) where it is located.
The operation of own laboratories, such as producers and manufacturers, shall comply with the requirements of GB/T 27025 (or equivalent ISO/IEC 17025) standards and encourage approval by CNAS (or equivalent accreditation body).
Third-party laboratory registered in China should pass the inspection and inspection agency qualification certification. Third-party laboratories registered abroad must be accredited by CNAS (or an equivalent accreditation body).
6.2 Ability requirements for self-selected laboratories
a)Should have the technical ability to carry out the relevant compulsory certification standards (valid version) of the test.
b)Appropriate personnel should be appointed to take charge of laboratory management and support the product type test of the CCC self-declaration method ‘self-declaration procedure A’ to be conducted.
c)Ensure that laboratory personnel carry out type tests in accordance with applicable standards for compulsory certification;
d)The technical capacity needed to ensure the effective implementation of type tests should be updated in a timely manner.
e)Should have the ability to issue complete and accurate type test reports.
f)The type test report issued shall meet the needs of the producer for controlling the consistency and conformity of the product.
g)Should be able to upload and manage the type test report, change report and related information of the self-declaration product of the relevant producer/authorized representative in accordance with the requirements of this implementation rule.
7 Post-market supervision
7.1 The CNCA is responsible for organizing the implementation of the self-declaration results and the supervision and administration of the use of the CCC mark. The local certification supervision and management department is responsible for supervising the use of the self-declaration results and the use of the CCC mark in the areas under its jurisdiction. If any violation of this rule is discovered, the provincial certification authority must upload the relevant opinions in the disposition in the compliance information submission system of the CNCA
7.2 When one of the following situations occurs, the producer/importer/vendor shall stop the shipment, import, sale and recall the self-declared corresponding product; the conformity information submission system shall revoke the self-declaration and information related to the producer/authorized representative, The producer/authorized representative suspended its acceptance of newly added self-declaration information before completing corrections in accordance with relevant laws and regulations; related dishonest information was included in the unified record and disclosure of the social credit system:
a)The self-declared corresponding product has been verified by various levels of certification supervisory and regulatory agencies to ensure that there are serious defects and that the product safety testing items are not qualified;
b)Self-declaration corresponds to product defects that lead to quality safety incidents;
c)Refuses to accept supervised sampling;

e)Defrauding, using unfair means to complete self-declaration and information submission, or other serious violations of laws and regulations that directly affect the validity of self-declaration results;
f)Other circumstances where self-declaration and information should be withdrawn.
7.3 When one of the following situations occurs, the producer/authorized representative shall implement corrective and updated relevant information. If necessary, the producer/importer/vendor/commercial user shall stop selling and recall the relevant product:
a)Factory or imported products are inconsistent with self-declaration corresponding products;
b)Failure to correctly mark the CCC mark as required by this rule;
c)Failure to sign self-statements as required by this rule;
d)Self-declaration and compliance information submission content does not meet the requirements of this rule;
e)Failure to provide technical documentation or technical documentation does not comply with the requirements of this rule;
f)The product or its packaging/attached documents do not show producer and importer related information;
g)Failure to meet other regulatory requirements of this rule.
7.4 For the producer/importer/vendor/business user who commits the 7.2 violation or the 7.3 violation in two times, the CNCA will publish the list and the penalty result.
8 Responsibilities of related parties
The producers (manufacturers), authorized representatives, sellers, importers, and business users involved in adopting the self-declaration method of this rule shall strictly abide by the requirements of laws and regulations such as the “Product Quality Law of the People's Republic of China” and bear the responsibility Corresponding responsibilities and obligations for product quality.
Annex I Self-declaration procedure
1 Self-declaration procedure A
1.1 Producers shall implement internal quality control in accordance with the requirements of this self-declaration procedure to ensure that their commitment to the quality of the product meets the requirements of this rule;
1.2 The product is subjected to type testing by a self-selected laboratory and a type test report is issued to prove that the product meets the requirements of the applicable standard for compulsory certification products;
1.3 Producers establish technical documents in accordance with the requirements of Annex II of this rule;
1.4 Producers should aim to ensure that their self-declaration products continue to meet applicable standards for compulsory certification, in accordance with the requirements of the rules and corresponding product certification implementation rules, should establish factory quality assurance capabilities and conduct self-inspection based on product characteristics and production and processing characteristics, and issue a self-inspection report;
1.5 Producers should mark their self-declaration products with the CCC mark;
1.6 The producer/authorized representative shall sign the CCC self-declaration for the specific product and keep it for at least 10 years from the date of completion of compliance information submission. The CCC self-declaration should specify the specific product model name;
1.7 The producer/authorized representative shall be able to provide the CCC self-declaration and relevant information as required by the certification supervision and management department and the market supervision and management department;
2 Self-declaration procedure B
2.1 Producers shall implement internal quality control in accordance with the requirements of this self-declaration procedure to ensure that their commitment to the quality of the product meets the requirements of this rule;
2.2 The product shall be type-tested by CCC designated laboratories and shall issue a type test report to prove that the product meets the requirements of the applicable standard for compulsory certification products;
2.3 Producers establish technical documents in accordance with the requirements of Annex II of this rule;
2.4 Producers should aim to ensure that their self-declaration products continue to meet applicable standards for compulsory certification, in accordance with the requirements of the rules and corresponding product certification implementation rules, should establish factory quality assurance capabilities and conduct self-inspection based on product characteristics and production and processing characteristics, and issue a self-inspection report;
2.5 Producers should mark their self- declaration products with the CCC mark;
2.6 The producer/authorized representative shall sign the CCC self-declaration for the specific product and keep it for at least 10 years from the date of completion of compliance information submission. The CCC self-declaration should specify the specific product model name;
2.7 The producer/authorized representative shall be able to provide the CCC self-declaration and related information according to the requirements of the certification supervision and management department and the market supervision and management department.
Annex II Technical Documents
Producers should establish technical documentation. The technical documentation should be sufficient to confirm that the product meets the Compulsory certification requirements and should include an adequate risk assessment analysis. The technical documentation should specify the relevant requirements and contain information on product design, production, and use.
Where applicable, technical documentation should include at least the following:
- 1. Product description;
- 2. Product technical data, such as: design and production drawings, key components list, circuit diagrams, structural drawings, etc.;
- 3. Description and explanation of technical data, product use/operation instructions;
- 4. A list of the applicable standards for Compulsory certification of products;
- 5. Type test report.
